Commercial debt recovery – what you’re owed

Being owed money for your services can be downright frustrating, especially if you’re doing the chasing. That’s where commercial debt recovery comes in.

What are commercial debt recovery services?

If your business is owed money, our commercial debt recovery services will go through the following steps.

First contact letter

The first point of contact will be an official letter on your behalf requesting the settlement payment of the outstanding debt.

In this letter, we’ll give the debtor a set time frame in which to make their payment.

Under the Late Payment of Commercial Debts Act, you may also be owed compensation. If this is the case, you can leave it all to us.

Legal claim

Ideally, the first letter will be the be-all and end-all of our debt recovery process, but sometimes, this isn’t the case.

If we haven’t received any reply from the debtor, we’ll move forwards with entering a legal claim through County Court. We’ll send a court form requiring them to pay the debt (plus interest) and costs within 14 days.

County court judgement

A county court judgement (CCJ) is an official order confirming the debtor has defaulted on their payment. As soon as the expiry date of the legal claim has arrived, you can order a CCJ immediately. This is a final decision by the court which gives us (or you) the power to take enforcement action to collect the debt.

Enforcement

Enforcement is one of the final steps in the commercial debt recovery process. The collection process itself will depend on the amount your debtor owes you.

If the total debt owed, including costs and interest, amounts to £600 or under, they will be sent to the county court bailiff. For any debts over £600, we’ll send them to an enforcement officer.
